We live in a ground floor masionett and the guttering needs to be repaired. In our deeds it states that it is a joint responsibility with the owner of the upstairs flat. I have contacted them but they have not responded. What can I do next? Is there a legal route if it gets to that stage?

Write it down on paper 2 copies one to deliver to them in person and make sure its dated signed by you and a reliable witness for them and one for your personal records......they will have a few days(up to a week) to respond to it but if they don't ...then you have the work done to the place get all paper work make copies of the bill(s) the estimates court fees and all that good stuff so that you have proof and if it does go to court sue for the work the court fees and everything should go your way

Write the tenants of the upper floor flat advising them that the deeds say that the matter is a joint responsibility and that unless you get their agreement within 7 days, you will cause the matter to become a matter dealt with by your Solicitor.

The other option is to have the work done and charge them for their share. If they don't pay you, the County Cort will make an order or send Bailiffs in to secure goods to the value of their unpaid costs.
