My son has his dads last name, but since he's no longer in the picture I would like to change it to mine. Is it difficult to do?

You should be able to as long as:

1) the child is a minor
2) you have SOLE custody - on paper not just "dad's no longer in the picture"
3) there is nothing in the separation agreement/divorce decree against it
4) the child understands and agrees (unless an infant)

Of course; whether you should is another question due to identity confusion, loyalty issues, grandparents etc.

To my knowledge, you must run an ad in the newspaper for a certain length of time, stating your intentions...IF you can't find the father. If the father IS available, you must obtain his permission...go through probate court and have the name changed. It will cost some money, too.

The best thing to do, is call your local probate court and ask what their proceedure is, because it MAY vary from state to state.

Believe me, you can't just run down to the court house and have a child's name changed at random. If you could...non-custodial parents would be doing that, and running off with the kid...never to be found by the custodial parent.

First answer is more or less right but the father would need to consent. But this is obviously for your reasons. Think of the child first!!!

Many adopted children seek out their real parents. Your child might like to retain the name even though the father is not there. If you change their name now they may end up resenting that and you in later life!!

Think of your child not yourself.

No, it's very easy. It costs about $40. Call your local court clerk and ask about the procedure. There are a few forms to fill out and the fee, and it's done.
