In some states and areas it is illegal, however at this time I know of no state or area that it is illegal to use one that is hands free.

Depends on the State / Municipality. New York State and the City of Chicago do have laws banning cell phones while driving. Most other places do not.

Also, even where it is illegal it is usually only banning holding the phone to your ear to talk.... if you use a headset (bluetooth or otherwise) you may be OK.

I know of no state with an outright ban on use of a cell phone while driving, but I do know that Connecticut and New York require you to use some kind of hands-free device to do so.

The federal government has no jurisdiction over this issue, so they haven't yet passed any federal laws about it. I suspect they will, in time.

It doesn't just depend on the state. Some states don't have the law for the whole state, but some cities have adopted the no cell phone law. Chicago is one of those cities. The suburbs, however, have not adopted the law.

Not in all states but it should be. It's illegal all over the UK with an on the spot fine and points on your licence if you're caught. I still see other drivers speaking on their cell phones though, I don't answer mine if i'm driving.

In certain states it is illegal. For example in NJ I know its illegal. You would have to consult your own state's law for your specific cell phone rules.

this is a state issue. I think there are several states which are trying to ban talking on your cell phone while driving. Some states are trying to ban smoking, eating, talking, and everything else while driving which i think is absurd!! But to answer your question, it is a state issue
