Because mortgage/lien info and the new sale price are all obtainable through the register of deeds (or whatever it is called in California), he probably did not break a law.

He did break your trust and air information that you did not tell him to talk about.

Send a letter stating your severe disappointment at his conduct. Tell him rather or not this will keep you from ever using him in the future.

Congrats on making money on the sale!

What you made is a fact of record and anybody can find it out.
I can find it out with just your address.

Here is how.
You find out how much you owe, the loan or loans.
That's a public document because the lien is recorded.

Then you get the price of the house that you sold it for. That also is a fact of record.

Then you subtract one from the other and you find the amount. The only variable is the amount of real estate commission charged and the agent has to be honest and say what he charged you when asked as thats the law, he can't lie.

I don't know why you are worried? The only reason why someone would worry is if you told your neighbor one thing but the truth is another thing lol...then it would be kinda embarrassing.

But the true answer is everything is a public record. I can pull up your info right now free on the internet with just an address. I can know your sqaure footage, loans, and even the name and phone # of the owner.

It is common practice when someone wants to sell or move that the agent shows recent comparable sales.

You haven't been damaged in any way financially and the only time I have seen it where it embarrassed someone is if they told the neighbors, for example, I sold my house for $400,000 but in reality it sold for $350,000 then the neighbors find out the seller was fibbing.

I too, am a Realtor in California, and from a legal aspect, everything he/she did was within the letter of the law. Where the deficit comes is in his/her fiduciary responsibility of utmost care to you-his/her client. He/she is not supposed to discuss any material facts about the home or the sale process with anyone without your WRITTEN permission as it could compromise the deal. Even now with the sale behind you, damage could still be done. If the buyers find out about this, and something even as miniscule as a torn screen on a window, this could lead them to believe that you didn't disclose everything about the house in the interests of making a large profit, and therefore you would find yourself in court defending your actions/motivations. BAD REALTOR, BAD, BAD REALTOR.

Theoretically, this is public information, at least to a degree.

Anyone can look at the county records and see how much you paid for the home when you bought it, what loans you had against it, and what you eventually sold it for. Deeds and mortgages are available for public viewing.

However, no normal person would just go down and search the county records, just to be a snoop.

It was unethical for him to divulge any of your information to anyone for any reason though. His only answer to a question like that should have been: "If you want to know, you can go down to the county and look. I don't discuss my client's private financial matters." File a complaint with the local board of Realtors.

Look! Anything that would be part of the public record can be disclosed by an agent legally. There are probably some ethical issues but that is how agents drum up business...people want rael life examples of transactiona you have done and if it is for pple they know, even better.
