My friend (him and I are both 20) is dating a girl who is 16 almost 17. They are really are happy together and I dont see a problem with the age or anything but they both wanna have sex. I told him it was illegal till she was 18 but he said she is over the age of consent (which is 16 in Maryland where I live). Not sure if he will do it or not but is he right about it being legal. If she is over the age of consent can she consent to someone 3.5 years older than her?

In the United States, legal dating age is 16. That means you can have sex, with anyone of any age with consent. That's really scary but it's true. I am 17, and I have been sexually active since 16, my parents know, and my mom said that at 16 it is the legal age.

I'm not a lawyer, but there's no way I would do it. Why doesn't he ask her daddy? I'm sure he'd set the record straight. I think the age of consent is for someone more age appropriate. Those are confusing ages because even though there are only 3 years apart, both parties are at different stages of their lives and they should be separate stages. I tell my daughers two years difference is a great rule of thumb. It does make a difference.

If the consensual age is 16 it's fine, he may want to verify that, even with her consenting if they get busted he will be branded a sexual preditor for the rest of his life. BUT, she is a teenager, he should wait until she at least is old enough to handle the emotional responsibility that comes with having sex.

Nope. Over the age of 16 is only legal if the person they are sleeping with is only 2 years older than them. He can STILL get in trouble and go to jail. Not to mention being on the sex offender registry for the rest of his life. (I have a friend who made this mistake.) Tell him to wait. It is not worth it.
