under no circumstance can you ever shoot a fleeing suspect. we aren't even going to get into how much trouble you would be in for just discharging the firearm while running down the street. frist off is the gun registered, are you allowed to use it, meaning if it is a handgun do you have a permit to carry it in public, and of course are you withing 500 feet of a occupied structure. these will all be charges against you even if you miss the guy and he gets away.
Oh and by the way, the law your friend was refering to is called eminant domain. it allows you to defend yourself, your family and your home from intruders, attackers, and animals shoud one menace your home. you are allowed to use any force needed up to and including deadly force if the intruder is not fleeing or outside of your home. if he is in your yard talking trash and you go in the house the law says you need to call the police because he is no longer a threat to you or your family if you bring them in with you. if he tries to follow you in though then feel free to light him up like a christmas tree. as long as you can prove that one of more occupants of the house where in mortal danger and could not flee then there is no state that does not allow you to take some measure to protect them. most states require equal or lesser force so if the person comes in and says he is going to shot you but has not gun then you can't shot him. but if he has a knife and says he will stab you to death, then fire away, JUST DON"T MISS, and never leave him breathing, or you might get stuck with his doctor bills, the difference between attempted murder charges and manslaughter is normally about 1 to 3 years if convicted.

We are sorry for you, since you live in california.

I don't know what the law is in california...however, regardless of what the law is, if I am in my house and someone intrudes, and I feel my kids are in danger...I am shooting them.

I will roll the dice on the prison term.

With the liberal leaning of california though...I doubt you can shoot someone for anyreason. You should talk about each others feeling about the situation first, before you ask him politely to leave.
