what can be done if someone posts a picture of ur underage children on a website without your permission?

someone took my 19 month old sons picture and posted it on a myspace page that has comments and pictures about sex and alcohol on it..

ok, i posted the picture on my very family oriented myspace page, and they copied it.. i dont really care about suing ,, unless its the only way.. but i just want his little innocent face off that disgusting page..

i actually have tried contacting myspace, three different emails.. but i keep getting generic replies about how to upload pictures or something.. i dont think its real people writing those.

Because it's myspace, its a really easy answer-
Contact them via email and tell them you want your childs picture removed.
Myspace may ask you to present them with another photo or two of the child to prove that they are really yours, or may even ask you to take a picture of yourself with your child to prove they are yours-

This is a common problem. Especially with teenagers trying to claim that someone elses young child is their own. Myspace will work with you. They are really good abou tit.

Probably the only solution would be to sue in state civil court, for violation of privacy (public disclosure of private facts).

That assumes they took the picture. If you took the picture and had it posted on your website, that wouldn't work. But in that case, you could sue for copyright violation.

There aren't a lot of legal remedies generally available, though your state might have additional state-specific laws that you could use. Consult a local attorney in your area.

it's actually a lawsuit with that individual that placed the photo with out your approval
