sorry to ear about your friend ,now you know why American /African complain.and i bet no witness's ,except the passenger of the cop car ,his partner in crime .
they all cover with the same blanket's ,the whole department cover for each other ,its a brotherhood in crime .
God i hope you guy's have the money to fight this ,with a good lawyer ,they are not above the law ,forgot to read the amendment rights .Texas just got in big trouble officers got fired ,for a teenager got raped and beaten with the officer's blessing ,the Mother is like a bull in a china cabinet ,she's cleaning house .

No. There are specific exceptions that police officers are allowed to do as part of their jobs (carry firearms, carry or buy drugs as part of a sting, speed during a pursuit, etc.)
But police are still subject to all other laws. And in the example above, the police actions would at the very least be a violation of federal (section 1983) civil rights laws.
As far as reading him his rights, that is not required during an arrest. It is only required if the police intend to interrogate him, and even then the only penalty for failing is that they are not allowed to use any statements against him if he rights were not read prior to interrogation.

BS! Cops get away with crap like that all the time. If any one questions them, they conveniently get a fellow cop to back up their story. There are very few prosecutors out there that will ever even press charges against a cop, and if they did... who is the judge and jury gonna believe? The "public servant" cop, or your brother who now has a record???? The whole system is screwed! And PLEASE never be fooled into thinking that a cop "just wants to talk you" and NEVER be stupid enough to think that a prosecutor wants anything to do with the truth, no no no they just want to get convictions to make their record better. The people need to wake up to just how corrupt the US legal system is!!!

It has been my general experience that if you give some one a military uniform. a gun, distinctive powers. that they will use them....They certainly don't appreciate a legitimate challenge to their authority!!!!!!!!
It may be a perception of many officers that it is them against the evil empire and their job is the most hazardous on the planet.......both propositions false. They seem to be evolving into a para-military force rather than a public service organization. Even though new technologies are evolving every day and they receive oodles of ongoing training, most departments forward the argument that we need more and more of them or we won't be safe in our beds at night...meanwhile, it's not uncommon for someones sleep to be disturbed as they break down the door to the wrong house.........Just need to say oooooooop's....SCARY !!!!

yes. with the patriot act officers of all kinds were granted more power. they are above the law. decisions that affect you are up to their discretion. and it is the gateway to fascism. when you give people power they will abuse it and i witnessed this first hand. I'm sorry to say that i dont know what to tell you to do because i still dont know what to do myself. you can report them, but then you are only giving them reason to single you out if you ever meet again, and i really doubt they would be punished at all. I'm really sorry. the only thing to do is vote, and vote for the right person, protest, let others know what is going on. most people have no clue that they gave up their rights by allowing the patriot act into effect. they gave up their freedom under the illusion that they were protecting it. most officers now have the same mentality as the SS, Nazis. good luck

Yep it his word against theirs and judges get paid from the same funds the cops do .That means if the cops are sued and the person wins theyll be no christmas bonuses for anyone. Why was or friend asking to have his rights read to him anyhow ? sounds like there more to the story

The police officers don't necesarly have to read you your rights, it's when they book you. About the amount of force that they used you can actually go to internal offices and put in a complaint.
