If employee is doing a fraud unknowingly, will she be arrested? The employer is not allowed to sell to some XYZ companies. A new employee joins and unknowingly keeps selling to those companies and employer does not stop her...will she be at fault?

Deosnt sound like an actual criminal offense. Certainly doesnt sound like fraud. My be an act against business policy - but that's a far cry from fraud.

That isn't a fraud, first of all. Yes, she will be at fault, but her fault may be mitigated on a personal level by lack of training, insufficient information, etc. However, she takes that fault upon herself by working for the company in the first place. Yes, that's quite circular, but that's how it goes. As for being arrested, she can be arrested, but it is unlikely that she will be charged with fraud if she did not know she was committing fraud. However, she will be used at trial against her superiors and company, etc. and will probably be good evidence of their fraudulent conduct. But, the info you have provided does not suggest fraud.
