I had the same problem with my asparagus popsicles. In Canada, article 413 , part 3 of the grocer's stocking act states that if a product is available and readily sought, the grocer must make every effort to obtain that product.
I simply reminded the grocer of the well known article and he conceded. It might be a bit different in the States, but you could give it a go.
