my sisters husband ran out on her about a mth ago she has been trying to get him to come get his things but not this weekend she has plans of her own he insists he can come get his things anytime he feels like it an it will be this weekend any advice

I think they're both rushing it. She has plans, just to "get even", and he wants to come get his things then, just to break up her plans. They both need to sit down and talk, like two rational adults, and see if they can't salvage this marriage. If they both decide there is NO way, then they both need to heal some, before getting involved in another relationship. They're BOTH "jumping out of the pan into the fire". They're BOTH wrong!

If they both shared the same home, then he has just as much right as she does to go into that home and get his things. If she has a secure and safe place outside the house she could leave his things, she could carefully pack them up in advance and have them out there when he comes.
However if he thinks she hasn't removed ALL of his things then that could lead to a court battle over possessions they have together . Not a good thing.

Get an attorney or call the local police station...many states have laws that since he moved out he is no longer a resident although they are married and he cannot just come in or out as he pleases. Change the locks on the door, tell him he is not welcome and will be trespassing if he comes on the property.

She should ask him which day this weekend he plans on coming to collect his belongings and if he names a specific day, she should tell him she will have his things ready by a certain time and if he is not there at the time she specified she will leave them lying on the porch.

Throw his stuff out on the front porch and tell the local law enforcement that he is coming to get it.If there is any damage to the property or any signs of breaking and entering then they will have a pretty good idea who may have done it.

The wife should pack up his clothes and put them outside and change the locks on the house so he can't get back in.

I agree with Violet, that's what I would do...actually, have done it. But the things were not packed, they were thrown in a pile with a box of black plastic garbage bags neatly set next to it.

If they are plans that cannot be moved / changed he should have enough sense to pick another day. If he disagrees tell him you will get the police involved.

She doesn't have to be home for him to get his things. Unless she had a restraining order put on him, he can pretty much enter his house when he likes.
