My sister has accussed my partner of vandalising a car on her property & tail gating her son on a public road. She has put these accussations in a letter which she has sent to my mother. She has also said in the letter that everything has been reported to the police. All of this is a lie & we suspect that she or members of her family actually caused the damage in an attempt to set us up. I have contacted the police & she has made no such complaint. These accussations have been going on for 12 months with the final action being the letter to my mother. Although we haven't any direct financial loss these false accussations have taken a considerable toll on my partners & my health. I am suffering from depression & I have been to see a pyschologist to help deal with it which has cost me money. I have also lost money because I have been trying to set up a new business & the whole thing has made me so upset & depressed that I have literally lost days in setting up my business.

The toll on your health could be argued as damage. However you would need in this situation to demonstrate a direct link between your sister's actions and your health that involved the defamation of character. You have not stated the key fact here. As it would seem the only person your sister really told was your mother - you would need to demonstrate that your mother did believe the story and that has led to the damage.
I think you will struggle to prove damages as a result of not setting up a business that did not previously exist.
There is nothing preventing a valid case from being filed just because you are filing it against a family member.

Yes you can. Just watch peoples court or some other judge show. You can sue anyone you'd like as long as there is a definite purpose. I think you should and some advice is take natural medicine to cure your depression over the counter drugs have to many side effects. My dad works in natural medicine if you want email me and I can give you his number and he can help you. He is also a psychotherapist (emotions and depression anxiety so on and so on . . .).

Quit crying about your situation and do something about it. Confront your sister. Don't take this to court, the last thing judge's want to hear about is family squabbles. Be an adult.
