Okay I thought of this name "Romantique Interiors" 5 years ago,and even bought a webdomain that since expired. Well, I was doing a search on it and I found 1 company that now is using that name, and they bought my old domain I let go.

I searched the trademark office, and no one has registered this name, so if I purchase a trade mark will I be able to tell them "this is my name"?

No. They will be able to prove that they were using that name before you registered it. It does not matter that you once used that name prior to their claim. They will be grandfathered in.

Yes. Hurry up and trademark the name. ASAP. Gene Simmons of KISS discovered one day no one had trademarked the shortened version of orange juice, OJ. He went and trademarked it and now gets a check for a couple of hundred dollars every month.

Yes, if you purchase the trademark than by right the name is yours.

If its not registered then its anyone's name who wants to use it.
