Um, I've heard of crime minorites commit against whites being labeled as a hate crime so I'm not sure where you're getting that from. I personally label all crimes based on race, religion, sexual orientation, etc a hate crime regardless of who's committing it. For people who don't think it's a hate crime, maybe they think that because whites, or heterosexuals, were the ones who started hate and discrimination first it's like twisted justice? I'm really not sure, but that's my guess.
edit: no, not all people are "a bit racist". Only ignorant people are racist in my opinion.

That's not true at all! There was a case in New York last year where 4 young black men chased a white man into traffic during an attempted robbery. While committing the offense, one of the young men said "Get the white boy". The victim was struck and killed by a car while fleeing his attackers. They all were charged with murder and bias crimes. So see, you must learn that black offenders do get charged with bias crimes, too.

I'm not "a bit racist" as you put it. if the black and hispanic person did it because of them being white, then it's a hate crime. when it's because they did something to them, then it's just a crime.

Sorry to have to break up your little pitty fest..but ...........it is only a hate crime if you commit an act against another person BECAUSE of their race, sexual preference, etc. It IS a hate crime if a Black person does something to a white person because they are white just like it IS a crime if a homosexual person was to commit an act of violence against a hereosexual person BECAUSE they are straight.

Crimes are only considered hate crimes when there is racial or homophobic motivation behind it. Not all white on black crime is deemed a hate crime. When their is evidence of a person having racist or prejudiced views of a group that the victim is part of then that crime is seen that way.

All of the acts you describe can be considered and prosecuted as hate crimes.
It all boils down to whether the victim was selected purely because of their race, gender, sexual orientation, eye color or other bigoted basis.
Statistically, more minorities (of all kinds) are victims of hate crimes since there are fewer of them, and people who hate feel more justified to pick on them, I guess. I really can't explain prejudice, sorry.
But to answer your main point, ANYONE who has been a victim of a hate crime, often evidenced by accompanying hate speech, can pursue this presecution. Just don't confuse this with random crime, where the victim is not selected by one of these bigotry factors.
