Unfortunately if you both cannot come up with an agreement before court, your attny's will submit a request for items. The home could go to you if you win custody of the child between you. You will not get additional funds for the step child unless he adopted. If you lets say provided 30 percent of the household income, then you can probably see another 20 % from him for alamony, then child support at roughly 25% of his income. If he did not provide any income, then he will not be required to pay anything in most cases, and you might end up paying him alamony. Basicly the judge can determine who gets what and how much money.

I am not a lawyer or anything but I do believe if you gain custody over the child that you had with him and he earns more money than you, you should be able to get some child support money. As far as the house and items within it: everything you bought is yours. The house is another issue. Since you both probably contributed to it the court will have to resolve that. Unless one of you completely paid for it then that person gets ownership.

You seem to have an issue keeping guys. You brought your step daugher into another family (i apologize if your first relationship ended by the passing of him).

Unless he is a cheater, what is the real problem. He may also be able to prove problems in your relationships and his 1 child. he has no control over the first child unless he legally adopted her. But your first relationship and him may be able to take both of your kids away from you and boot you out of the house.

I need more info here as to the situation of you wanting a divorce.

ignore that first comment - who knows why you're deciding on divorce (prob for the best, right?) you'll get some sort of support. and it depends on the laws in your state for the rest. In Indiana - everything a married couple owns together is split equally and whatever the other person wants - they have to make an offer to pay for half of what its worth.

I imagine who file for divorce first get to stay in the home. If you two own it in most states you will have to sell it and spit the money between you. If he love his child he will try to help support her. And you will have to give him his belonging. In Florida everything id 50-50. Anyway, the kids always suffer in a divorce. Have you two try to work it out?

I wonder why people like you get married in the first place. You didn't tell us how many people you sleep with and what's the reason that you're thinking of divorcing your husband.

You cheated didn't you? And now you expect to take half his stuff? I hope you have a long, bitter, drawn out court battle and end up with very little.

In any case, you must have an attorney, most probably. Get a GOOD one and go for his advice, whatever he figures you are entitled to. Good luck.
