No. The patriot act is just that, an act passed by the house and senate. Both houses would have to pass a declaration of war, which we have not, in order for the president to remain in office pass his designated term.

Accually, not really. If he did that on this issue, (He has done it on others) they would swear in the next president anyway. The Supreme court would rule that the new presidnet was the real president.
However, USAPA does contain a provision for an attack killing the president elect and VP elect- in which the current president could remain in office until a special election could be held. But that's very limited... And the newly elected person would take office right after being elected, unless it's still before Jan. 20th.
To the Absolute IDIOT below me: GWB has subverted the constitution many times. Any law can contradict the constitution until stricken down by the supreme court. And I know the constitution a lot better then you do, I'm sure. I know it backwards and forwards, I doubt you can tell me what article 6, section 1 paragraph 2 says and what it means (without looking it up)

It holds that any treaties made are valid as law in the United states equal to the constitution. This would include things such as the Geneva Conventions and such.

i doubt it. the constitution cannot be overridden without an amendment, which must be passed by congress. not that the politicians actually follow the constitution...the dems, in fact, can recite the communist manifesto or mao's red book before they remember exactly anything the constitution actually says on anything...
