k my friend walked out of her job 2day,, she is due 2 weeks wages and 3 weeks paid holidays,, is she still intitled to these 3 weeks paid holidays ???

no legally shes not entitled to her holiday pay.
she is entitled to her 2 weeks pay but not the holiday pay,
she would have been able to claim it if she worked her notice but it sounds like she didnt so no. sorry

Assuming this is in the uk, she is entitled to any wages for work done. It seems a lot of holidays to be due, as normally holiday years run either from Jan-Dec or Apr-Mar. I would guess that she is due the statutory 4 weeks per year. Holidays are 4 weeks pro rata for the year. You only get 4 weeks if you are employed for the whole year. If you are employed for 6 months of the year, you only get 2 weeks holidays etc. If her holiday year began in January she would only be due 1 week holiday. The employer cannot keep any of the holiday pay due. This is an illegal deduction. The employer would have to raise a court action and prove the employee caused a real monetary loss to the business to recover any money from her.

I don't know about legally -
But I would not pay her a dang thing except her paycheck. I would make her take me to court to get it.
What kind of employee just walks out. Not one I would want to keep around if you ask me. Unacceptable.

If they are holiday entitlements from this last year 2006/2007 that she hasn`t taken, but she has accumulated by being employed by them for the last 12 months then I would have thought so. They make take some off her in lieu of notice though. She is not entitled to any holiday leave for next year 2007/2008.

it depends if she gave notice, and when you sign a contract of employment it normally states a time of termination where you have to give notice when terminating your employment with a company. If she had no contract, she should be able to, if they do not pay her she should be able to settle in a small claims court. The company would settle if anything went this far, but if there is a contract and it was broken on her side as she walked out without giving a due period of notice on termination of her contract the company could see that as breaking the contract of employment and refuse to pay her

She is due Holiday pay at rate of 1.5 days worked per month. So if she walked out after a week she would get nothing. If she walked out because of boss/workers abusing her, she has a good claim for unfair dismissal. Really needs to see a lawyer. Sorry about the abuse you received by the tossers on here. regards...

If she has accrued vacation or holiday time (flexibly personal days, not fixed calendar holidays), then she would be entilted to that money in addition to her wages for work already done.
However, if she failed give proper notice or otherwise violated any company policies (or any laws) in the way she left, should would also be liable for any damages that directly resulted.
