Can anyone help with this in the UK? 15 years ago I had an accident and broke my back, I had to move back with my parents 5 years ago when I just couldn't cope on my own any more. I still managed to keep my job but only cause my bosses were and still are very understanding and try to help me as much as they can.

5 years ago I applied for DLA and was awarded the high rate mobility, so I applied for a Motability car and I've had one ever since. I re-applied after 3 years and was again awarded the same, the doctor they sent to assess me said that there was no way my condition would ever get any better.

I've just applied again and have been refused, my whole award taken away, I've had a reconsideration, still no award. I'm now due to hand back my car in May so I have to give up my job, public transport is 45 min walk, bus, 20 min walk, 2 trains, 45 min walk, so thats not an option. I can barely walk from house to car. I now have to go to appeal and am scared, any advice?

I've have a welfare rights officer who is coming to the appeal hearing with me, but if I loose this award I will loose everything, car, job. I can't afford to buy a car myself, and cause I will be "voluntarily" giving up my job I can't claim unemployment until I find something else

Apparently no information used in previous decisions is taken into account when the current decision is being made so the doctor who came out cannot help.

My GP is a complete waste of time, I moved to a new area and she doesn't know me and has never asked anything about my condition, just doles out the morphine like its paracetamol. So I can't rely on her either.

My old surgeon did kindly provide letters from all 10 years he treated me and I've included them with the appeal forms, but I've no medical personnel that can help me now.

Excuse me "REBEL" but please keep your negative opinion to yourself. I'm not some benefits sponger and there is nothing to be 'found out' this is completely genuine. A distressing situation like this does not need some idiot making stupid comments. Have you been forced to give up your job? Are you able bodied? If yes, then you have absolutely no idea what its like to live like I do, I'm only 38 and my life is ruined because of this accident, I'm only asking for a little bit of help from the government I have paid to for the 20 years I have worked

Don't give up, if you contact your local Share the Care organization they can help, the number will be in the Telephone directory. I believe they can supply you with help and also maybe supply an advocate to go to court with you. He/she will be able to get your benefit awarded if you have all your records to hand.
If your circumstances are still the same as when their own doctor assessed you, then I can see no problem and the Advocate will tie the panel up in knots!
If you have improved and are seen to be able to get around unaided, then they might consider you don't need the higher rate. If they think you are likely to improve they will cut your award. I think they should not have refused you completely, unless they have been watching you or someone has reported you, telling them that you are more mobile that you say.
Good Luck with your appeal.

That's tough. Get in touch with your local paper (they love this sort of thing) and your MP. Find out when his/her next surgery is, and make an appointment if you have time before the appeal. Write and request an URGENT meeting. Good luck.

Thats absoloutly outrageous but i think the fact that you have been told you`ll never fully get better and have the welfare office with you should help alot,it makes my blood boil to think that lots of people who don`t even deserve it can somehow qualify, hope things work out for you, goodluck.

It's been my observation that appeals when represented usually win.. Get a strong letter off you GP to back you up.
