she was there 4 months, she had a 55 gal. fish tank that I put in my house and set up while she was there and she told me then that I could go ahead and have it b/c she would get a new one with her taxes... she moved and its 8 months later and I have the fish tank still.. and she left a email saying she wanted me to bring her fish tank over to her new place what do I reply to that.. she gave me it and plus I have bought a new filter,heater, rocks and fish for it I don't want to lose money on it for sure

Remind her of what she told you:

Tell her that you thought that it was a gift because she said that you could have it, and because she hasn't said anything about the tank for 8 months, you believed her and bought a new filter,heater, rocks and fish for it.

If she denies that she said that, or says that she changed her mind and wants it back, tell her that it isn't right for her to leave her tank at your place for eight months with the impression that she gave it to you.

Although she is wrong in this instance, don't push the issue after making this point.

Either buy a new tank and tell her that she can pick up her tank after you get a replacement tank (it isn't your responsibility to bring the tank to her, since she moved into your place), or offer to buy the tank from her at a reasonable price.

If she clearly stated that you could have it, then it is yours. I would email her back reminding her what she said and add to the point that you have already bought many supplies for the tank. If you don't really want the tank, which I think you do, I would ask her if she wants to buy all the supplies that you had already bought for the tank. I think that is reasonable, considering you were under the assumption it was given to you. Plus, it is not your responsibility to bring her SUPPOSED fish tank to her NEW place. God, I hate former roommates! I hope she still doesn't have a key to your place!

Remind her that she said you could have it and you already bought your own accessories for it. Hopefully she'll be diplomatic and let you keep it as she originally agreed. If she denies it then set up a time for her to come get it. Get everything out of the tank that is yours (including the fish) and give her back the fish tankwith only what she left it with.

'Possesion is 9 tenths of the law'--she left it there for 8 months, which means she had no intention of keeping it. Personally i don't care about 'things'--but you already bought the accessories for it--if she wants it then she can come and get it. If you really want to press the issue--she'll need a court order to come in and get it, she cannot just come in. I would never let a good friendship end because of a fish tank though, so think about it.

Remind her of her agreement, and if she still wants it back, tell her you'll get it ready for her. Make sure you have a specific day set, then get it ready to move, but keep all the items you bought for it, and tell her the reason is, you are going to get a new one because you liked it so much. She may tell you that you can just keep it, or if she still wants it, then make sure to keep your stuff.

remind her that she told you that you could have it and she would buy a new one. explain all the money you put into it already. if shes your friend she shouldnt expect you to give it back. maybe even offer to buy her a few fishies??
