Fiance wants to adopt my daughter before we get married in September. Natural father left when I found out I was pregnant; he wanted me to abort, I said no, he left. Paternity was never established; putitive father registry never done; he is not on the birth certificate; no child support paid; have no idea where he is residing. Do I have to name him on petition and do I have to serve him notice by publication?

Most likely your fiance will not be able to adopt your daughter until the two of you have been married over one year. Judges like to see stability before they allow the adoption, and they equate a year long (or longer) marriage with stability.

In order to have your husband adopt your daughter, you will have to give her biological father the chance to object. He will have to be named and served, possibly by publication.

You really ought to use an attorney for the adoption. You want to make sure you do everything correctly so that the adoption is done correctly. The attorney will also know how to go about getting the biological father's rights terminated so that your husband can adopt.
