I was fired on Monday 3/19/07. They told me they were firing me cause I didnt follow through on my work with the dealers (engineering company), I didnt keep up with paper work, I slacked, and didnt help to train new employees. 1st off I was an Accounts Receivable, I shouldnt have to train the news SALES REPS. If I didnt care about my work, then why did I find $400K that the last 2 A/Rs didnt place If I didnt care why did the aging reports go from 7pgs to 3 in a matter of 6 months and why did they give me a $1 raise last week??

I'm 99.9% sure they fired me because 1 of the bosses and I didnt get along. He would come to work High, steal company material, make sexual comments all the time, invaid personal space, and force people to talk to him. I feel because I complained about these things to the CEO (who is the Dad of this jerk) that they felt threatened that I'd complain to "Higher Powers". I dont feel that I was fired because of my preformance because I knew that I did my work 100%

I don't see how they can use my work preformance as an excuse to fire me, when EVERYDAY I was getting praised on how good I was doing, and how much I've saved the company... WTF is wrong with these people!! Now they don't want to give me unemployment, because they didn't put "Terminated" on my last pay check, they're telling the EDD office that I quit! WHAT LIERS!!!

You have two options. Accept that you were dismissed, file for unemployment, and move on OR pursue legal matters with your former company.

If you do the latter, you will need two things: a lawyer and all the supporting documentation you can. For example, you stated you complained to the CEO about sexual comments from your boss. Document when this was stated and his response at the time. See if you can recall what was said and when. Do you have proof of this person stealing? Do you have your former employee evaluations? Those are key - if they all state you are doing wonderfully, a sudden dismissal can be problematic for the company.

Many states have the option of being an "at will" employee, meaning you can leave at any time and the company can dismiss you at any time. However, dismissal requires some rational, as usually does leaving. Just not showing up for work one day saying you quit will burn all bridges with that employer. Still this "at will" process may offer some protection for your former employer, so be prepared.

If you indeed have done all that you stated and have proof of sexual harrassment, then your case is strong. Do NOT complain about your boss "invading your personal space" unless you felt violated. The reason is that such a comment is far too subjective. Only deal with "cold hard facts". You have to think as if you were the PROSECUTING lawyer (i.e., not the one defending you). What would that person zoom in on? What weaknesses are there?

Keep in mind that this will not be a fast process, but I wish you the best. In an ideal situation, your former company may decide to settle with you and remove the stigma of you being fired (say that you "moved on"). But don't count on that without a fight.

It's difficult to assess without all the details, but it's looking a bit suspicious to me. If they have actual proof that your work targets are not met, that is one thing, but it seems as if your work was not below standard so they don't have any solid evidence?
I know that people get cross with sexual harrassment payouts and they think people are doing it as an easy way to make money over something little, but I think it is a serious problem and it sounds as if you have suffered because of this. If this boss guy comes to work high and makes sexual comments then I don't think it would be beyond him or other management to get rid of you for "causing trouble", it doesn't sound like they have too many morals!
From a layman perspective it sounds like you do have a case, and that you shouldn't lose out on money or your career when you didn't do anything wrong. If you can, seek proper legal advice and take it from there....and good luck! :)

If you have proof of what you say you have a case. If not then you are most likely S.O.L. due to the fact that most States have what they call "At will employment" this means that you can be fired at will without a reason. you can also quit at will for no reason and no notice.

Like I said, if you have proof or witnesses that will testify about the sexual advances then contact the E.E.O.C. and file a complaint.

check your state because many state are what they call "at will employee" meaning they can fire you whenever they want and don't have to give you a reason. if you can prove it was for wrong reasons like descrimination (especially because you complained about sexual comments) then you'd have a case but because they gave you a reason that had to do with job performance unfortunately you probably can't do much

Even though you're not really asking a question, I would suggest seeking legal counsel that specializes in employment issues. Most of them will talk to you for free and tell you if you have grounds for a lawsuit.

Also, check to see if you're an "at will" state.
