A person can file a report against you for Assault but only a prosecutor can charge you with a crime and it is the State that will be pressing charges on the victim's behalf.

Teens can go to juvenile detention or youth centers or be put in state custody and placed in a group home or foster home. Depends on the kid's record and family situation.

Unlikely that he/she would go to an adult jail/prison.

Anyone can file a charge against you!!! The State (prosecuting attorney) is the person to process the charge and file it with the Court. As far as being a teenager; teen will be arrested and then put into a juvenile detention facility until he or she appears before the Court. At that time, after the judge has reviewed the case, the judge will determine at that time whether or not the teen will be charged as an adult or juveline. Different states have different laws on this but the basic "front end" procedures are the same! Good luck to you!

Courts do not like to send juveniles to jail! The court will determine the seriousness of the event to determine the best course of action to take.

The State of Alaska may have recently passed a new law requiring a minimum of 60 days mandatory jail if an assault 4th occurrs on school property.

Not stating what the assault was...verbal or physical...as a minimum I can see the court placing the teen on probation, paying restitution for any medical or legal bills, and possibly community service.

It depends ... he might go to "Juvie" (Juvenile detention), or may be
tried as an adult (probably not with 4th degree).

In any case, yes, he may be detained against his will.
