I'm not a fan of Tobey Maguire, but I think he did a great job as Peter Parker and Spider Man. My only complaint about the movies is that Spidey almost doesn't wise-crack at all, which is weird because it's such a part of the character, but that's not really the actor's fault.
On the other hand, and I don't know why, it seems to me that Jake Gyllenhaal looks a lot more like Peter Parker than Tobey Maguire.

If I was the director of Spider-Man, in all honesty I wouldn't go with Jake G or Tobey Maguire, but actually go with James Franco. The reason why I am saying that I would go with James Franco is because of the fact that James Franco actually tried for the role of Peter Parker/Spider-Man in the film.
However, that is not the main reason why I would go James Franco. The actually reason why I would have picked Franco to play Spider-Man is because he shows more acting skills and embodies the notation of a hero, while to me both Tobey and Jack embody more of the whiny loser that is doomed to play lame roles.

Just about anyone can play Spider-man, but there are few people on this earth that could portray Peter Parker and capture the fascinatingly complex depth of his character and being. Tobey Maguire is one of those few.

No, he wouldn't have been. But he has done a fine job since they chose him. He captures the angst of an everyday kid who has a lot of responsibility thrust on himself very well. I agree with you that Jake Gyllenhall would have been great too-- seemingly better than Maguire-- but I wouldn't change anything now that I've seen the earlier Spider-Man movies. Besides, when the first Spider-Man movie came out, Gyllenhall was an unknown, so people would have been complaining about his being cast as Spider-Man.

I agree with JON H as far as the wise-cracking goes.
Spiderman needs to wise-crack more. which brings me to my choice for spidey.
Back in the 80s when there was first talks of a spidey movie, I think a good choice back then would have been Jim Carrey ( not now, but back then when he was doing teen flicks such as Once Bitten, etc).
I think he would have done a good job. The fact that he can diversify as an actor and also has the potentail to bring that wise-cracking aspect.
Mind you that was then so its just wishful thinking by me.
Tobeys alright but I like the Franco idea

Tobey Maguire would most definitely be my first super duper choice to play Peter Parker/Spider-Man, and will most definitely and super duper absolutely continue with the franchise as well.

no one has been chosen rather, interior the form Tobey chooses to bow out of the area...yet he will stay, if Sam Raimi directs lower back(because he has directed all 3 so some distance)...the subject is, that Sam could be directing "The Hobbit" for sparkling Line...So, Spidey 4 might have a sparkling director, and doubtless new ideal guy and woman
