Where I work, If we have a banquet or a big group and they pay with a credit card, we have to give the owner 5% of our tip. He says it goes towards the cost of swiping the credit card, but I don't believe that it costs that much. To me, that is one of the costs of running a business, and I feel that it is wrong to take away from the wait staff. So, I was wondering if anyone knew if what he is doing is legal or not.

This is not legal. Contact the National Labor Relations Board for your local area. Employers cannot take money out of your income without a legal obligation or a written agreement.

I'd like to know who is paying taxes on that 5%. That is wrong on several levels and I guarantee he is not paying a 5% commission (1-3%) He is ripping you off. This is a normal cost of doing business.

I think that it is wrong to take from the waitstaff... If he was saying that he needed to charge the group 5% for the credit card processing fee then I could see that... I've done that before and added the cost to the group bill because you do have to pay the fees for using the credit card.... I would look up the labor board for more advice to see if illegal...
