She wants to move in to her boyfriend's home with my three small children. I believe it is morally wrong to bring 3 small children into that situation. The schools here are much better here as well. Financially she is doing poorly although I sent three weeks child support at a time she does not even go to the post office to pick the check up.Fortunatly I am doing fine financially and can support my kids emotionally as well. She thinks I am just jealous that she is with another man while my true concern is the welfare of my children. I already filed for sole custody before this with the hearing coming up soon. How will this situation effect what already is going on?

unfortunatly unless she is moving out of state you cant do anything about it unless you can prove to a judge that you would be a better guardian. I do know depending on the state you live in you can keep your kids from staying there overnight because they are not married-It is a temporary solution and once they are your hands are pretty much tied. I would try talking to her and maybe calling a lawyer.As far as the child support goes unless you can prove your kids are suffering financially all a judge will tell you is your job is to pay-is it fair? no -but thats they way it usually works-try finding a common ground with her if she is a good mother than it shouldnt be too hard.

The best thing to do is stay focused on your goal, and that is to gain custody of your children. Make sure your doing this for the right reasons and not because you are a jealous ex. When you go to court make sure you take records that you have been sending money for the children and that you can offer them some type of financial and emotional stability. Its sad but true in society when a father wants to take responsibility the courts make it difficult..

Courts look as woman taking better care of kids then men, however the welfare of the children is supposed to be the main concern. Her living with a man but not married may not set well with the courts, talk to your attorney.

a court will rarely favor the father of the children. it's hard to get the kids away from the mother. see if you can get some more dirt on her and the guy.
you may come off as being jealous, show that you do send money and that your in a better location, you're more financially stable etc.

No experience--just observations
Usually a judge will not take the children from the mother, unless the situation is pretty bad. But it is good of you to try and good luck.

Make sure you have a good private investigator to keep the lawyer aware of everything going on with the X and her new boy toy.

You can take her to court.What you will need to do is called "modify divorce agreement" Then you can ask to make it so she can't move out of county you live in..In the State of Maine you can do this I do not know about your State but it wouldn't hurt to find out..Best of luck to you..

Explain her charecter infront d court.M sure if not all atleast one or two kids u will b able to get.Wat a kind of mother she is??? dont leave ur kids to these kind of selfish women.
