maybe he goes on it when im not there - but im not really sure he normally likes to stay behind the filter or heater.. but does swim ok and eats

My RES does the same thing. He always swims around and is hardly on his dock. I notice that he's on there between 4 and 5 mostly, like he gets tired of swimming.

Dont worry about it, but try to get a natural feeling place for them to get out of the water. My baby western painted turtle only sleeps on a piece of driftwood suspended out of the water because it feels good I guess. Things that are smooth and that they cant get a grip on they dont normally like. The Zoo Med Floating Turtle Dock that sticks to the side and self levels itself seems to be a turtle favorite, but it needs to be held up with something for a turtle over 4 or 5 inches(depending on type of turtle and dock).

Your turtle sounds healthy, if he's still swimming and eating. Dont worry unless you note a change in attitude.

If it is new to its home it can take a week before it starts to act normal or eat well. Turtles are stressed by changes, having giants stare at them, new noises and lights, etc.

Also check tank temps- 75-80F water, about 90F basking site.

if they are scared they tend to stay in the water most likly u just put him in there. but if not make sure the dock is not to cold or way to warm. i beleve 86f is perfict
i no my res will not go on the doc when im any where in the room but when im gone i can peek threw my window and se him basking but as soon as he sees me hes in the water

Are you using an UV light on him? You may want to start supplementing his diet with dark green leafy vegetables, they are high in vitamins A & D, both things that he gets from UV light. Additionally, they provide him with extra Calcium. All of these nutrients are crucial to Carapace (shell) development.
