this is a strange situation i have taken ex husband back to court for child support modification i also went back to college at age 38 we have divorce for 11 years took 3 years for him finalize. he is currently unemployed since he rec papers at time of original hearing he was conveintly unemployed now 14 year old son wants to go live with him. he ex is currently living with his brother and the two of them are promising all sorts of things since i do not work but go to school and new husband does will this look bad for custody i will not let son go told ex he would have to sue for custody no job no stable home i live in indiana pro mom state father is behind on support and is to pay for all sports he has never paid any extra also he is pay 60% of all uninsured medical bills never has, i do have a right to have it modified correct and a right to say to him that he would have to sue for custody? ex is also behind on support

Any father who has never kept current on his child support is blowing smoke saying he wants the kid. You'd win. You should take him to court for back child support.

if he tries to sue or w/e...then you can just say that he has no job ect. w/ stuff like that will not him get custody...just use all the negative things against him if he does try
