This was totally out of the the blue, and this was my initial reaction. But the will was posted within 24 hours and I realise now that was what the deceased really wanted. I have tried to contact the solicitor but he hasn't answered my calls. Am I within my rights to to regain executorship?

Reinstatement as executor of a will must be approved by the court to protect the interests of the testator. Thus, file a reconsideration of your decision in court.

Usually only one executor is named and another is named in case the first one can't do their job. I never heard of co-executor because co means two of you would have to totally agree on things and normally there are arguments instead of agreements. If there was one executor only and you reneged then the other executor was named.

The executor's position is an important one because they sell houses and cars and take care of the accounting and pay the bills, take care of the obituary and burying, and doling out of the money that at the end is left in the will. Are you prepared to do that? You're not going to make any more money on the deal whether or not you do it.

Cant answer the questions as it depends on where you live and the state law there... keep calling lawyer and put concerns in writing too

keep ringing your lawyer, the sooner you sort it out with him the more chance you will have
