He gave himself that power by passing the "Homeland security" act.
He can do whatever he wants under that bill including spying on anyone and everyone. If you are against him, you will be considered a terrorist .

Presidential Executive Orders and Proclamations are legal documents and have the same effect as laws. Executive Orders are authorized by the President's statutory or Constitutional powers, however a great many Executive Orders violate the Constitution by usurping legislative powers granted only to Congress.

Yes, I believe he does. There are basic freedoms that have protected us citizens from government tyranny for centuries, such as the freedom of speech, and the right to privacy. The current administration seems to have hyped up threats of terrorism to the point that people are really scared. Because of our fear, and our senator's/ representatives' fears, we have allowed our government to make hasty decisions that allow certain "unalienable rights" to be pushed aside in the name of national security. Maybe at the moment these new laws seem to give us a peace of mind in a time of great hysteria, however, we failed to anticipate the effects this may have on our children's future. While the laws (like the patriot act) seem to be innocent and virtuous enough at present, who knows what politicians will be using them for 50 or 100 years from now. It is quite sad, if you ask me.
PS. - check out the movie "V for Vendetta". While it is just fiction, I believe it is an excellent social commentary of America's current dilemmas (expecially in regards to this situation).

We are going to see how much power the President actually has when Congress starts to subpoena members of his administration. I think you and everyone else will see that the system of checks and balances set up in the Constitution is still very much in place.

No. Despite the fact that the president gets blamed for everything under the sun, there are checks and balances throughout the system. There is very little the president can do without the consent of the congress.
