I had a case of vandilism on March 9 and was put on juvenile probation which requires me to do community service(which I will do) and not get suspended from school. However, I have been wrongfully accused of another case of vandilism which may send my march 9 case to court. However I cannot be unsuspended(maybe I can, please tell me how) So what will happen if my case is sent to court? Will i have a criminal record? Will I spend some time behind bars, maybe longer community service? Please tell me....I'm 15 years old and I go to a high school in New York. I will turn 16 early this May.

It is really not practical to expect tailored advice on here. I assume you have a lawyer, if you don't you should get one. Your lawyer will be able to give you better advice.

The only thing I can say is that you should be as honest and forthright as you can. Respect the court and show contrition. Starting the community service ASAP will also help. The judge will is only likely to be harsh with you if he/she feels it is warranted.

As far as any reliable predictions nobody here is going to be able to help.

I also went to New york public schools and understand how strict they can be when it comes to prosecuting it's students... However if you are in fact being falsely accused of this latest vandalism charge I would threaten the filing party with a civil action as well as criminal charges. Filing a false report with the police is a criminal offense and the courts take those cases seriously. Also you can sue the filing party for defamation of character/slander on a civil level for basically labeling you as a vandal. I am a pre-law student and if someone falsely accused me of something criminal I would have an absolute field day in court with them and would probably end up paying off all my college loans with their savings account. If you are being falsely accused get an attorney (if you don't already have one) and file a complaint with the court clerk for an action against the complaining party (whoever reported the false vandalism) and he/she will be served and ordered to appear in court. This is a good way to turn the tables, a law suit is not only a dispute resolution process but also a form of a threat. People do not want to go to court and stand before a judge so they will be very motivated to settle. Hope this helps and gives you an idea of can happen. Good answer CB.. This is the first time I honestly agree with you 100% ;-) .. Too many times on here there is advise given that really isn't in someone's best interests. And saying that leave the counseling to an expert (lawyer) is the best answer. Thumbs up from me..
