and I want him to move out because he is not only spending all of our money on drugs but I am afraid for the children's safety. My question is, the house we are renting with a lease option has both our names on it and I am the one who put the money down from an inheritance from when my father died and since we're married, is it possible to get him out and if so, how?

Please help.

Call the police they won't let him come back home if he's a threat to you and the kids. They will most likely put him in a rehab.

drugs in the house with children will cause a run-in with child protective services. these people can help of hurt your situation. the police can't do much unless there is domestic violence involved and still that is just a night in jail. however,domestic violence groups can give you the info you need because oftentimes someone addicted to drugs can become abusive.walk on egg shells until you take action and be sure you have all your bases covered. if you have other relatives that can take the children for a short while then do that.the longer you wait the more dangerous your situation may become.

file a restraining order and if your wanting a divorce then when be the time to do that as well but with the restraining order ask for custody of the children put in the reasons your scared of your husband and they will direct you on how to get your husband out. on the restraining order ask for you to stay in the home with the children so not to upset their life more than it already is . and if your husband is already abusive from the addiction see if someone will stay with you . you can not predict how someone will act or when they will act on anger while on drugs and ask for temporary relief from him for you and your children. but that is it in a nutshell . where you file your restraining order in most places is the magastrates office, or sherrifs department in your area . tell them everything and they should make sure he is out of the house before you get home . then they will set a hearing date for your restraining order where you will tell the judge what is going on why you need the restraining order and then he will grant you the order.and talk to a lawyer or legal aid in your area they are very helpful as well they will give you the advice and the necessary steps to follow . good luck and take care

i say hire an attorney. you can always start there. when dealing with someone on drugs...talking will never ever help. he may have to lose everything before he starts to get his life right. but start with an attorney to begin protecting the rest of your assests. if you share anything else (other than the house that you are living in) then you need to start separating everything from him. your own bank account, your own job and see if you can change the mailing address to reflect that of a person that you trust (such as a family member or a friend). he could go through the mail to see if there is anything in there that he could use to support his drug habit. and file a divorce.

Call the cops on him. File a restraining order, citing the drug exposure to the kids and have him served.

if his name is also on the home, he doesn't have to leave. it doesn't matter who put the money down, all that matters is whose name is on the paperwork.but maybe if u filed for divorce, and got a restraining order, maybe that would be a way of getting him out.

go talk to a lawyer they should be able to help and depending on the age of your kids you could set no visitation rights until he can prove by test taking that he is not doing any illegal drugs! good luck

Find proof that he is doing drugs for sure. Thats all u need is proof. With the proof you can file for a proper eviction.
