Should he/she be given the choice of how to die and the sentance be carried out post haste?

no choice....no death sentence is cruel and unusual punishment...you should have thought about that before you got on death row...sorry for their idiocy..make your bed...sleep in it and quit whining....

They can appeal the sentence if it is not legal by state law. The state Of South Dakota held off an execution for one man, because the way they were going to proceed was legal defined under state law. They where going to do this last summer but had to Wait until the next legislative session to correct the procedures and make them part of the state legal code. Now as to how fast someone can be put to death depends on any lingering legal questions left to keep any or all parties sued by family after the excution takes place.

Most states do not allow the defendant to choose, though some might. I haven't reviewed every single statute personally.

If he wins the appeal, and the appellate court finds one method invalid, then the state legislature can attempt to find a different method. Otherwise, it falls back on the next allowable sentence.
