This is my situation. A girl that I had worked with came at me screaming and yelling , and she was pushing on me with her chest. In my defense, I put both of my hands on her and pushed her off of me. She went backwards and screamed " You put your hands on me b@#%&!!" She came after me again and started grabbing on me. She had ahold of my left arm and was pulling at me as someone was trying to get her off of me. I remember my right arm was swinging trying to get her to let go. I don't know if i had hit her in the process but, she said that I punched her in the eye. This girl came after me and I was only trying to defend myself. Am I in the wrong here, or should I have been fired? The Employer's rule is : Unacceptable conduct resulting from fighting or assault of another. They say I was aware of this rule and that I have violated it. But how is this? She came after me. If this isn't self defense, then I don't know what is.

Stupid rules, but they're someone's rules which you have to follow (whether they're wrong to you or not). This may sound crazy, but if you had just let her hit you and just screamed for help, she would have been the one getting fired. That's life for you. She seemed to have been provoking you, so I'm assuming she hated you and wanted you out anyway. Get another job, let this go seeing as dwelling on this doesn't help you get anywhere. You need to go around searching for another place to work at instead of being home asking questions about what already happened.

If she was pushing you first, you had a right to defend yourself and push her away. Then she came at you again. Your problem appears to be here, when you admit you were swinging your arm. That can now be considered aggressive behavior, not self defense. Self defense is blocking her punches or letting the other people there finish pulling her off of you. I hate to see people who were trying to do the right thing get the shaft, but you are probably screwed. Sorry.

If you don't win the appeal, then appeal again. In Arkansas you have 3 different appeal processes you can go through. If you lose all appeals, by then, as long as you are claiming each week, your disqualification should be up and you ahould be able to collect by then. It's complicated. Employers look for an excuse not to pay unemployment. You need to get a lawyer and fight for money. Good luck!

Get an attorney. I hope that your former place of employment has video surveillance and that they have not destroyed the video yet, that is pretty much your only hope.

Was there any surveillance video or witnesses to corroborate your story? You can try bringing them into your hearing.
