She and I are having our first child together and I want to do the right thing by her and ask her to marry me. I know age of consent laws says that she can get into trouble for being more than 4 years my senior but is there a way we can overcome it. I am legally emancipated from my parents and they have no say as to my decision but have offered to be there for both of us if we need the emotional support. I can support us on my property rentals and a trust that was left to me by my grandparents which provides a good income for me. I know she is not a gold digger because she makes good money as a lab technician. I am just a guy needing some help!

To the best of my understanding you may marry. And she shouldn't have a problem in your state because of your age. (statutory rape) The age of consent is 16 in NC. So, no problems there. http://www.coolnurse.com/consent.htm

But since you are emancipated, I suppose bringing in the documentation of that would be consent enough.

Ok, first of all she should be locked up for statutory rape! Second the child should be taken away from her because What kind of Woman sleeps with a boy of 16 ,now I'm sure you are going to be upset with me writing this but the fact of the matter is You are just a child your self 16yrs old You still have 3-4 yrs of High school for god-sake! You think you are in love, but your not your 16 years old and everyone knows how teenagers know everything! You don't know anything about life, How the hell could you. Your parents should press charges against that girlfriend of yours and give you a kik in the ***! And drag your butt to school everyday! Trust me getting married because you got someone pregnant is not the answer ,Try talking to some people that have been down that road. It can be emotionally and financially draining. I hope you really get ahold of your thoughts and don't make any harsh decisions that could jepoardise your life, and the little person you will become Father 2 . It's not all about how you can afford a kid by the way!

Be very careful with the law...
I suspect that you will be able to work it out though..
Consult a NC attorney...
Start by researching NC marriage & age laws on the internet.
I believe the age of consent in NC is 16 but you are emancipated so that should not be a problem...
Call the local clerk of court and ask...
( Don't mention the pregnancy )

No offense, but your g/f should have been arrested a long time ago. What she is doing is statuatory rape. You should not marry her. Being legally emancipated from your parents does not give you the right to marry so young. You need to end this relationship, get some counseling as to why you got involved with someone so much older than you, and make sure you support your child. This is a scary situation.

There is much that can be done to your 27 year old girlfriend, despite the fact that you are an emancipated child. The state in which your child will be born in can file criminal charges against your girlfriend for having sex with a 16 year old child. Despite the fact that you are emancipated the fact still remains that you are 16 years old and in any state in the United States of America that is called molestation.

If I were you, I would be asking the question of how will my girlfriend fill out the birth certificate of our unborn child, since I am a minor and she is an adult, without her going to jail.

I recommend you go to the local Dept. of Social Services and speak to someone there. If you are legally emancipated they may have some information that can assist you. Also, if you are legally emancipated, go to the Register of Deeds office and ask what is the procedure for a marriage license. Short of that, see an attorney.

Your heart seems to be in the right place. At this point, your gf is in big trouble with the law. I hope you can somehow work this out because judging by the well-written question you pose, you're obviously mature for your age.
Get some legal counsel. Hopefully, since you're an emancipated minor, you will be able to at least give this a shot. Good luck.

There is alot of things I could say much i do not want to judge you or your girlfriend.
I think you should wait for at least 18 months to 2 years before you decide to marry. If you wait 18 months to 2 years, by then you will be 18, and an ADULT! Then, you can make your own decisions.
Your heart is in the right place. Understand though, many men out there take great care of their children WITHOUT getting married to the mother.
I am not advocating you DON'T marry her-I am just pointing out that FACT.
If you want to marry her because you love her; she loves you, then I say once again, waith till you get 18 in the United States.
Another thing-your trust will not be given to you until you are 18 anyway, so...

If you are legally emancipated, doesn't that make you legally an adult, and therefore, able to give consent? I'm not positive about this, but I thought that part of being emancipated was being considered a legal adult. Talk to a lawyer (hypothetically) about your situation.

You can get married if your parents legally sign off to let you. OR, if you are emancipated, you might be able to do this on your own. You really need to go to your local court house and find out for yourself. Good luck
