own hair salon on beach front property.....originally she told judge her income was 1200.00 per month he basically said he did'nt believe her she then returns to court and says 3600.00 he accepted that I know that she makes more then that around 5000.00+ who can I call

You can't ever get and accurate record of someone 's income in a cash business. You are just S.O.L

Edit. For those of you that don't know. Tax records only show what you report not what you make. In cash business if there is no record of an transaction you can not prove that it existed. There fore you cannot prove income.

I am not a lawyer or an accountant, but I will take a shot at this.

The first question would be, "How do you know what she makes?" If you had some sort of access to her financial records because you were somehow involved in helping her keep her books, then I think the IRS would have an interest in her underreporting of income. (Plus, if I am not mistaken, you would get a 10% finders fee for any underreporting of income that she may owe. An added bonus.)

After calling the IRS, and assuming that your suspicion is enough to have her audited, I think your lawyer could petition the court for the records of her audit. This may or may not be within the court's authority. I am not sure.

The judge you had is a idiot most are tho the judge should have made both of you present financial statements such as income tax statement etc. to the court but she deals in cash a lot in her business so she can hide a lot of income maybe you should have your lawyer have her bring her appointment book to court and you can get some kind of a figure from that.

The only way you will know the truth about her income is to get a look at her books. I wouldn't count on the IRS to be able to tell you considering she might be lying to them as well. You should hire a private investigator or just leave the matter alone. Thank you and good luck.

I am shocked he didn't believe her, she could be working part time. If she gets paid in cash you are out of luck, if she can account for every penny the court would have asked for her IRS statements, remember tho she has a right to consider her house as a place of business and electric and gas etc. So she may make 5 grand but it's not gross income.

A better lawyer. Apparently if she told the judge she made 3600.00 the second time she must of had proof. She must have a good accountant.

Try getting copies of their IRS records, credit card statements, etc. Subpena bank records. Many financial records are obtainable and their are reputable companies who do this. If they claimed they made $8,000/month on a credit app, and made less, it may be fraud.
Also, it's messy, time consuming, and kinda weird, but most folks throw out their statements and you can "dumpster dive" for them. Trash on the side walk is fair game, just stay off the private property.

YOU can't call anyone. Her income is not for public knowledge. What can be done is for your lawyer to ask the judge to order her 1099's [self employment tax documents] and her tax returns as proof of income. I'm surprised the judge took her word for it since they usually do not.

Even then she probably 'hides' some cash income which is easy to do in that business.

Your lawyer can reqest the court demand all banking records. Obviouslly, they can hide some cash transactions but not all that well. Good luck with that..
