I truly feel sorry for anyone who lost a pet and I think they should be reimbursed for the veterinary expenses. But this is absolutely ridiculous the amount of money being sued for. I have heard of over $100 million so far. I am amazed at the absurdity and greediness of the lawyers and plaintiffs in these suits. They are citing negligence on the part of Menu Foods. It is not their fault. If they want to go after someone for negligence, how about Con-Agra for the peanut butter they waited 6 months to recall. Or the spinach producer that distributed contaminated product that could have been completely avoided. They are not getting near the bad press or the frivolous lawsuits Menu is getting AND THEY INFECTED AND KILLED PEOPLE. I guess I know where we stand on the issue of what is more important, people or pets. I would almost bet that the same people suing would also like to see that baby polar bear Knut die "because it is not right to hand feed a wild animal". This will affect more than just a few businesses. This will affect thousands of families lives when the main or only income is taken form them if the businesses cannot survive this. There will be thousands of adults and children suffering and struggling to survive. Can they countersue for negligence and pain and suffering caused by the greedy bloodsucking lawyers and plaintiffs. Probably not because people are apparently not as important as pets.

Okay, the question was: Who do I contact about a Class Action Lawsuit against Menu Foods in the death of our family cat? Not: Do you think my cat is important enough to file a lawsuit about? Obviously, this person does think so (as would I) and your opinion about it "just being a cat" is heartless and unwarranted. I know that animals do not mean much to some people but the world to others. If they don't mean much to you, don't own one but please don't try to tell others how important their family member is. My animals are my children. They were eating this food and I cried all weekend. Fortunately for me they were not affected but I certainly want this company to pay for my vet bills and would ABSOLUTELY be looking into this more seriously if I lost one of them. I will be joining the class action lawsuit along with you if you find out any information. Believe me, there will be a lawsuit. Sometimes they just take time. Usually in a class action lawsuit a firm will try to determine who was affected. They will do a lot of research and then send out a bulk email/mail with all of the information. They will ask for things like receipts and so forth. You can also keep an eye open on-line (do your own research). Just be careful when it comes to fraud. I am truly sorry for your loss.

Doesn't anyone else think it is outright crap that very few (4) lawsuits have been filed regarding the peanut butter recall that made over 300 humans sick (reportedly some deaths) and was reportedly spread over a 1 year span before the recall was done, yet there have been over $100M in frivolous lawsuits so far filed over what amounts to a very low percentage of PETS eating this food getting ill or dying and the recall was done as soon as it was verified that the food was to blame. I guess people as a whole care more about our pets than they do for their family (especially children who love peanut butter). That is why the world is in the dire situation it is in. I am in no means down playing this. I have 4 pets myself that I love very much, but they are just pets.
This food was tainted by an ingredient from another supplier. It goes to show how underregulated the imports to this country are. If anybody out there thinks that the ingredients used in the so called "high grade" pet foods are any different than the "lower grade" foods they are kidding themselves. If they do it with human food they do it with pet food as well (Peter Pan and Best Choice peanut butter. Same lot number equals same batch.)

This might not answer your question specifically but it will surely give you some very valuable information. A class action lawsuit is being sought. See the link below.

Notices must be published in some form or another of the class action.

From wikipedia:
"The court will also examine the ability of the firm to prosecute the claim for the plaintiffs, and their resources for dealing with class actions; the court may, as due process requires, have complex notices sent, published, or broadcast to the public, in any place where the class members can be found.

As part of this notice procedure, there may have to be several notices, first a notice giving class members the opportunity to opt out of the class, i.e. if individuals wish to proceed with their own litigation they are entitled to do so, only to the extent that they give timely notice to the class counsel or the court that they are opting out. Second, if there is a settlement proposal, the court will usually direct the class counsel to send a settlement notice to all the members of the certified class and all the members of any subclasses (that might have slightly different but uniform claims), informing them of the settlement offer being made by the defendants, and the fact that the named plaintiffs have agreed to accept the settlement. Usually, the court will also state the legal fees being paid to the class counsel as part of the settlement, which may be considerable, making class actions appealing to many plaintiff law firms."

I have received notices of class actions in the mail, have seen them in the classifieds, and have received notices online of classes that I may have been a part of - in the past.

I'm sure you will see much more on this one.

I am very sorry for your loss. have been thinking lately about how I had not been giving my little Lhasa Apso any of those foods, and how fortunate I was in that regard. I'm so sorry you lost your pet.

Before you go jumping on a class action bandwagon you need to educate yourself about class action lawsuits. http://biyts.info has a pretty good definition and some solid examples of the bigger cases. If there will be a class action, the company will be punished and you will probably get $6. I was screwed by At&t out of $110, the lawyers got $30 million and the plaintiffs (us) got an $8 phone card. If you have real case get your own lawyer or fight them yourself.

To the people answering this inquiry, you know if you don't know the answer to this person's question just don't answer, but all the replies I see here are stupid and useless and a waste of time for people who obviously have too much time, Menu Foods is a dog food company not human food by the way, get informed before you type smartypants, and there is a class action suit for people who have lost their pets, I would like to know about it too because my dog also died under mysterious circumstances after eating one of the brands distributed by Menu Foods, so please idiots refrain!

My 9 month old puppy was put to sleep the weekend before Christmas because he was in renal failure in which the cause was undiagnosed. For an entire month, my 13yo son and 10yo daughter had to watch this dog suffer. Some days we had to carry him out to urinate and hold him up as he did his business. He had good days and bad days and we prayed that the home IV Therapy that I was performing and the round the clock meds that my family was forcing down his throat would make him better. When his bad days outnumbered his good days we had to put him to sleep. My children and I both witnessed this loss.
For those of you that feel that a pet is not an important member of a family, maybe you shouldn't own pets. There is no way that I could have put Cody Lee to sleep without offering him all that I could to try to get him better.
In Cody Lee's 9 months of life, he had been hiking and rode jet ski's. He did more in his 9 months than some dogs do in their lifetime. He wasn't just a dog in our house. He was the baby of the family.
I am a single mother and spent almost $2000 in that month's time and would only like my money back if they are responsible for his unexplained illness. I am not trying to purchase a new house but I would like them held responsible for the medical bills.
Of course, I will wait to see what happens with the investigation before I make my final decision. I owe it to Cody Lee, as well as my children that suffered as well, to stand up to Menu Foods for costing us a valuable family member.

I wish I knew because my cat passed on March 11, 2007 from Kidney Diease that just suddenly happened. We have blood work from 2 years ago to prove nothing was wrong with him then. To prove it suddenly just happened. His counts were near 142 (normal Kidney counts are app. 24). I have been searching the internet for info on if someone started a class action lawsuit against them. And if they havent maybe a bunch of people going threw the same thing.. to start one with them. I want to get at least the amount of Vet bills.. money wont bring him back but they at least can take the burdon off me for the dang vet bills. I miss my frankie dearly and wish that I never even gave him this stupid food. :

Anyone interested please message me or email me.
