We live in TX, my husband has a daughter from a previous relationship that we pay child support for & she lives in Ohio. Admittedly, communication is few & far between (both parties guilty). Now we're trying to get into contact with her, but so far have had no luck. We're using mutual friends, but it seems the Ex isn't willing to give us contact info.
I know there are Father's Rights, but am not sure how it works when you live in a different state than the child. Can someone enlighten us, please?

There are no divorce papers or a custody agreement. He wasn't married to her, they just lived together.

No court ordered divorce papers. She filed for child support after him & I moved to TX together. We didn't have the money to go back to Ohio for the child support hearing, so the amount he pays was determined by the court/judge.

No divorce papers? As in no court ordered divorce? The money he is paying is out of his own free will?

If there was a divorce then contact info has to be provided but in no way means he can withhold support. It has to be filed as a violation of a court order. If there is nothing legal on paper then there is nothing to force the issue.

Unless your husband has had his parental rights limited by the courts due to abuse/neglect situations, then he has whatever rights are outlined by the custody agreement and should be contacting a lawyer to ensure that his rights are enforced.

Also, keep a log (a simple notebook record or computer document will work) of every time you try to contact his daughter, what means you used and whether or not you were successful. This will help establish your case when you go back to court to enforce visitation.

It really depends on the divorce decree and the childcustody arrangement. Often, parents are not allowed to know the location of their child, whom they are paying support for. This happens frequently when there are domestic assault issues involved, but not always. This is not uncommon. Your husband should consult with an attorney to go over his rights with respect to his divorce and custody arrangements. He may have a right to know the address of the child, and even to receive copies of report cards, etc. However, he may not have a right to any info at all.

child support and visitation are totally two different issues, and handled separate at court as well.

today, child support is based upon BOTH parents incomes, thus the amount is not as high, and BOTH parents contribute to the support of the child. if one parent isnt working, the court will calculate an income for them and add it in... coming up with a figure.

doesnt matter if you went to ohio or not, the same calculations are used, even if your not there.

no, he's not paying out of his own free will... most dont pay it unless ordered to.

if they were married or not, he has rights. problem is, you have nothing in writing at this point to enforce those rights.

lawyers are expensive, and you can do it without one... but if your not comfortable doing it without one, get one. but if you do handle it yourself, simply go down to the county court house and ask where to file for visitation/contact rights-for your child in another state.

you will need to find out her contact info from the child support dept (they will have where the checks are mailed to, or they can call OH cs dept to find out), so that you can mail your pro se motion.

if they wont give it to you, ask them what you need to get it (get a court order, talk to the DA's office, write the Attorney General, etc).

in your motion just ask for every other holiday, or one month in the summer, or one week during xmas, every other year you get the child for holidays, child made available every night at 7-8pm your time, for father wants to call and chat with the child, etc. etc. (what ever you want).

the court will allow the ex to testify via telephone (most courts do today).

neither side EVER gets ALL that they want, but consider it a win if you get 1/2 of what you ask for... its always a compromise.. that way, its fair.

on a personal note, dont bad mouth the mama to the child, and when you get into that childs life, stick with it. with most, it gets 'old' quick and they end up finding excuses NOT to call or write or visit. dont do that to that kid... stick with it. show that little girl that not all guys are jerks, and that way, she will grow up feeling good about herself.

its a life long commitment.
