If a man hits a woman and she does not call the cops on him when he did it, but when he decides that he does not want to be in the relationship with her and wants her to leave and she doesn't, can she call the cops way after the fact and have him arrested?
It didn't happen to me but I know someone who this happened to and now since he knows she is not what she seems and does not want her around anymore, she is threatening to call the cops on him b/c she knows that he does not want to go to jail again. It happened last year and he has not hit her since. Will they arrest him and he is also the tennant in his apartment and not her so can he get rid of her?

Laws vary from state to state, so it would depend on what state they live in.

She may be able to file a complaint (that is if they will arrest him if there is no proof) but the likelihood of it sticking even if it is within the Statue of Limitations, is not good, especially if he can prove it is just "sour grapes" over his decision to end a relationship with her. He may even be able to asset she if filing a false report to try to keep him in a relationship with her.

As to whether or not he can evict her and how long he has to give her to vacate (if any) would be a separate issue; much will depend on the laws where they live, who's name is on the lease, does she contribute financially (and able to prove it) and how long they have lived together.

The smartest thing for the woman to do is to chalk it up to experience, move out and move on with her life and if any man every would harm her physically in the future, to file a police report immediately, take pictures of any bruises and seek medical attention immediately.

As always, things differ from state to state. But for the most part you cannot call the cops for abuse that happened a year ago just because NOW things are not working out. If she wanted to report it, she should have done it then. As far as him getting her out of his apartment...that is going to be a NO! If she has resided there for a certain amount of time regardless of whose name is on the lease, it is her residence too. The cops will not be able to force her out of her own residence. If neither one of them want to stay in the relationship, then what is the big deal? Agree on how to get out of it for the both of them!

There is a statute of limitations (time limit) on when police reports can be filed, and when charges can be brought. That time limit varies by state, and varies based on the offense.

If she files a complaint, and if the police find the complaint believable, then he will probably be arrested. It doesn't matter if he hasn't committed any more crimes since the first time he committed a crime. The law punishes people for what they did.

she can call the cops... but can she PROVE he hit her?? if she never filed anything at the time it'll be his word against hers.
