Does anyone have any ideas on how to get my money from him??? He owes over $5,000.00 to me for his son and life would be so much easier if he was paying me the money...daycare ain't cheap you know...

the police dont enforce the court order, the court does.

well the honor system doesnt work, thats been proven.

your right, daycare is a killer (30-45 per day). seems to me, you need to put some heat on the case... AND to write a letter. any time your caseworker (or dept) isnt on the ball, you need to apply some heat to the case. that way, they are on the ball more.

1) call your caseworker and ask:
--where you apply for interest on the arrears?
--was the case submitted for tax refund intercept?
--was the arrears reported to the credit reporting agencies yet?

2) sit down and write a letter. in it, give your contact info, case number, his info, arrears amount, him not paying support, the cost of daycare, and your caseworker/courts not enforcing it. ask them why a lien is not on his bank account and property. ask why his drivers license hasnt been taken. ask why there isnt a warrant out for his arrest. ask them what they are doing about it. tell them you respectfully request that the state/federal child support laws be applied to your case.

then take that ONE letter and FAX it to the following:
a) your states Attorney General (link is below)
b) your states Governor (link is below)
c) your states Regional FEDERAL Child Support Office (link is below)

if you live in separate states, then FAX it to his state as well.

phone calls are useless; they are ignored, denied and forgotten. mail ends up on someones "to do" pile, but FAXES are effective. its proof you sent it and proof they recieved it, therefor, they HAVE to address it. if you cant find a fax number (most are listed online) then just call them and ask for it.

if you hear nothing in a week, fax them again. fax them weekly if need be. its the squeaky wheel that gets the oil, if ya know what i mean. even if you miff 'em off, just keep at them... weekly, until this problem is addressed.

That's really difficult. About 50% don't pay their court ordered child support. A friend of mine, years ago, did the work & found his phone, address, where he worked and gave it to the state and after 5 years, she started getting back child support. It's just sickening that we don't have a better system. It does depend on the state so make some calls and don't let up on them. The more aggressive you are, the more likely you'll see child support. There may be support groups in your state that can help. Do some internet searches (your state, collecting back child support etc.) and see what you can find. Yes, daycare ain't cheap-good luck.

Ok, I'm kinda going through the same thing. My husbands ex-wife isn't paying child support. I totaly understand about life would be easier if they were paying. In Indiana you have have the wages garished and tax return checks garished for back support, but that helps if they have a job!

Child support is for the child yes, daycare is for a child to...... support is to help take care of the human being that both a man and a women brought into the world. If that means paying for the childs daycare then be it, or to put food in that childs mouth, or even clothes on that child's back than be it; that's what it's for. (Sorry I had to say that, some of these people saying that you shouldn't use child support for daycare but for the child... are very confused)

But talk to a lawyer, find out what options you have if that's garishing wages or not.

well, in my experience, I fought with the court system for 3 years, I ended up going to my governor since I applied through the Attorney generals Office, things got taken care of in 3 months after I did that. Also, you may want to hire an attorney. If you can't afford one there are Legal Aids out there that will help you for free. You can check into the companies who help recover child support, but I think you have to pay a fee to them.

Check to see if your state has a child support enforcement agency. My state does and the child support is taken directly from my ex-husbands paycheck.
And to the answerer who said child support should not be spent on daycare, do you really think child support is enough to live on without the mother working? I was getting $637 for 3 children. That isn't enough to pay rent, buy clothes, pay utilities and groceries for 3 children for one month.So, yeah, I also had to work. That's the real world and real life.

Alot of times the courts may not know where the father works. So, therefore you have to ask around and its mainly the people you and him know together that might tell you where he is working. I had the same problem but only when they started taking money from my child's father he would quit his job at one time he was working under the table. But, just keep at it and don't give up because you didn't make that baby by yourself.

If you have a court ordered child support against him then you can contact your local court house and get a bench warrant. If he fails to appear he will be arrested. And if he gets pulled over or gets in trouble with the law he will find out that he has a warrant for his arrest. Good luck!!!

Well good luck with that. Sorry, but unless he changes and stuff, you're not getting anything. My sis has 2 kids, one is 3, and for the longest time she didn't get anything, but now he is, even his girlfriend! Her other kid is only 9 months, but she doesn't get a dime from her dad.

So you just have to hang in there as long as you can, I know, it's hard.

The money should be spent on the child not on daycare. He would essentially be paying for you to not take care of the kid. Either way, your best solution is to stick with the law... any other way would get you in trouble. Contact the law as often as possible until someone finally gives you a hand. Being a single mother is difficult. Keep your head up.

Hire a family law lawyer. My dad is a lawyer and he says if you can't aford one try legal aid. But I'm sure you will be able to find a lawyer. Good luck!
