If u start as a small business no one will bother you. If u r big enough business to give comptition somebody will make sure u are paying royaltys for characters

Forgive me if I am worng, but the only restriction would be the kind of stuff you're filling it with. You can use wrapped candies and toys, but make sure you include a disclaimer about small children. You probably couldn't put booze in there without a license.

I would think if you are making them to sell, you may note be able to use characters that are copyrighted, such as Mickey Mouse {IE Disney}.
