I have no idea how I can get this information and my step mother is being vague about the value of my fathers estate any advise would be greatly appreciated. Also my fathers will left all his property and investments to be split with my step mother and us. Is the house part of this? I am in Canada.

Your stepmother can't know about the value of the estate until all the calculations have been done, the tax paid (there's usually some tax, even if only income tax owed by the deceased person) and all the investments realised. Treat her gently.

Whether or not the house falls into the estate depends on a number of factors. It seems likely that your father would not have disposed of his property in such a way as to render her homeless.

Important - do not sign anything without an attorney advising you on it. Make sure you read it as well. As a surviving child, you may have certain rights under the law to a portion of the estate (with or without a will). Speak with an attorney.

I do not know the protocol in Canada but generally in the States you can ask for an accounting when you are a beneficiary. You should speak to the lawyer who wrote the will or hire your own if you feel it is necessary.

Contact the attorney or solicitor that is in charge of filing probate papers.

Be patient with your step-Mother. Losing a spouse is not easy and she may be having trouble dealing with this.

Youll be happy you showed some restraint instead of going for the bucks.
