first of all call your credit card company and tell them to reverse the second charge, tell them what happened (that that company make a mistake) and the bank/company will honor your wish.

If you didn't get your product, give them a call (call the number also that took the money from your account). If you can't arouse them then send them a letter saying what happened and send it certified mail return receipt. If you don't hear from them in a few months then report them to the FTC, your attorney general, etc. but continue to send them monthly demands for your money back or the product.

If in 3 months they don't give you either you can take them to court. You don't need an attorney if the cost is under $5000. But you would need to pay the fee to start the case. If you don't hear from them also you could place a stop payment on your check if it's within a certain amount of time. See...you still have choices.

I would go ahead and dispute both charges. When you receive your order, let the credit card company know to accept only one of the charges. You have only so much time to dispute a charge and if you wait to see if you get the order, it may be too late to dispute the original charge. Internet shopping is considered mail order. Mail order law says the selling company must ship your order within 30 days or offer to refund your money. This is true even if your order is backordered. Also, there is some law about not charging your credit card until the item is shipped. Contact the selling company to see if they have simply made a mistake. It happens. If they do not give you an instant credit on one of the charges and a satisfactory answer as to the progress of your order, go ahead and dispute both charges.
