I am thinking of starting a nudist/Naturist website. The lifestyle is not illegal in any state as far as I know but I am not so sure that the presentation of that lifestyle would be legal.

Nudists and Naturists are fairly private in general. One aspect of the site I think would be attractive to registered users is the ability to have private photo albums that they can share with friends. This is what I am most concerned with.

I know that plain nudity is not obscene according to law. This applies to all age groups. Sally Mann and other photographers have fought that fight. But, would I be liable for what members placed into their private albums? What really is the risk here?

Nudity is an art but must not be abused especially against children.

I don't know where you live, but if you are based in the U.S. you really need to do some thorough research into attitudes where nudity is concerned. Some states like California and Florida are fairly liberal about nudism/naturism, whereas in Montana and Arkansas just to promote it is enough to land you in jail. Having a photo album is also a fine idea, but I'd advise you to be careful with having minors on it, especially with some ignorant ne'er-do-wells linking child nudity with paedophilia.
Your best bet would be to get the site hosted from an overseas country which is more liberal about nudity such as Germany, France or the UK but you can still base your operations back at home. The sites below will give you a general idea of what I mean. I wish you the best of luck, as I'm looking to get a website of my own up on the net too.

Though nudity is not illegal or obscene, there are a lot of people out there that do not share this view. If these people were to be allowed to view your proposed site, they have a tendency to become the screeching minority that gets attention. You don't need this type of attention.

As said above, you would almost have to make the site a "secret site" with massive security. How you would screen members????

Most sites that still show the nude lifestyle in photos are not based in the United States (hint!!!!). There is a very good site in the references.

You would have to find a way to secure and protect that website, and I don't know if that is even possible to the extent it would be needed.

I'm not a nudist, but if I were I would not want to post pictures of myself or my family on any website unless I knew I had strict control over who had access to that site.

Given the current concerns with pornography, especially child pornography, I would suggest finding some other forum for doing this. I know of no reason why you couldn't have a chat room or discussion forum dedicated to nudism/naturism, but I don't think you could trust photos on any such site.

You should cunsult someone who knows like a lawyer or something, and then if you start the website but everything under terms of service or something, where it says if they do something illeagla they will gat banned. I see your issue with the problem of enforcing it.
