If they wanted to prosecute, they probably would have already done so. However if he did not enter into a legal contract with them agreeing to pay it back in exchange for not being prosecuted, they have until the statute of limitations runs to prosecute.
The statute of limitations depends upon the state he committed the crime in, and the amount he stole. The amount comes into play because a lot of money is a bigger felony than a small amount.
Hope he learned his lesson. You shouldn't worry, they probably have no intention of prosecuting him. Good luck to you both.

He could still be prosecuted for theft or fraud, even though he has paid the money back. That will stand him in good stead if he's convicted though, as the magistrates (or possibly, jury, depending on the charge) will look favourably on his attempt to rectify things.

They still have the right to press charges, but it all depends on how he went about the situation. Why would someone steel from thier company in the first place ?
