He often wants to do bag checks and it makes me feel violated because anyone in their right mind at work knows I believe shoplifting is morally wrong and would never do it. Recently, some friends told me it is illegal. Is this true? What can I do when he asks? Can he legally fire me if I refuse?

I do not work for a big shop. It's a small video shop and we do not get much shoplifting. The only thing that ever gets lifted is a few movies very late at night. If we haven't had anyone steal anything, why should I be bag checked.

And by the way, I am the ONLY employee who is female and the only employee who is ever bag checked.

I'm not closing this yet. I've gotten a lot of people in real life tell me it is illegal and that this is harrasment. I want to see if anyone else wants to reply to this and maybe have a website with the laws.

He can only check your bag if it is stated in the handbook or was in the new hire paperwork and you signed something saying that he had your permission.Other then that he may not check your bag/purse.If you refuse and he fires you you have a great chance of a sueing him,let him know how you feel about this and if he doenst like it well too bad .Dont listen to your friends sounds like they are trying to intimidate you just as your boss is doing.Stand up for yourself and keep what is private to you private.dont let some boss who thinks he has pull invade your space.its almost like being violated in some awful way.good luck and TAKE A STAND

Any company in the US is legally bound to pay for hours worked. If you are in a work-at-will job (most if not all jobs at Wallgreens would fall into this category), then you can leave and they can fire you for any reason, or no reason at all. So it doesn't matter if you give notice or not - unless you are under contract or part of a union and your contract speaks to that. It's always preferable to give notice as a professional courtesy. Were I your job counselor in this situation, my advice would be to give your notice and let them know that you are not interested in staying any longer than necessary.

Depends lots of stores around here have signs right in the doors now "we reserve the right to search all bags" if htey do you are SOL they have prewarned you too many places are loosing out on shoplifters

I used to work for an aerospace co. in Long Beach. Everybody entering or exiting the plant had to open their bag, or lunch box, or anything else that could hide something. They even checked all our trucks and vans.

In general, yes they have the right. My employer actually request the women to use clear plastic bags so they don't have to actually open them.
