The short version is that I was denied a position at a local retailer and the only reason I could ascertain would be because of a misdemeanor that I was found guilty of when I was seventeen. The misdemeanor was supposed to be expunged upon successful competeion of juveille probation. Who'd have thought it would come back? The only other thing I could imagine it being is a bankrupty filing, but can an employer deny me a job becase filed chapter seven?

An employer may tender an offer of employment , or decline you as an employee without disclosing reasons in almost any situation. Interviewer's impressions, credit history, pre-employment testing, (including psychological), all are open to employers as resources often used today in screening applicants. Unless there is an overwhelming reason to suspect you were discriminated against because of race , age, religion, or national origin, you really have no recourse, and they have no obligation, legal or otherwise to inform you of why you were not hired...sorry...

You can actually be denied a position in a job for filing bankruptcy. If you choose to apply for a job that deals with large amounts of money, they will more then likely run a credit check. People who have bad credit or bankruptcy are considered a high risk for theft. they feel that you are in a financial bind and you may choose to be dishonest. As far as a misdemeanor goes, if you were a juvenile, a job can not use that against you to denie you a position. juvenile records are sealed unless a subpoena is ordered by a judge to reopen.

Yes and no. The juvenile record should be sealed. So most likely the bankruptcy is the problem. It will also affect rental homes, apartments and such. It sucks but many employers feel that a bankruptcy shows lack of responsibility, so they don't want to hire you.

Companies dont have to have a reason to decline your services.

When you have 2000 applicants for 1 job, you have to do something - I used to only consider 2 page single spaced arial font resumes. It isn't fair but nobody can spend that kind of time.
