The final check/balance: Any new law/regulation may be vetoed by the people by a simple majority vote. Opposition to the new law must be filed within the first 90 days, with a general vote held 3 months later.

We'd have booted that Patriot Act as it's written out of the park by now.

I would have written the whole appointment of Senators part differently as the way it stands it allows the State Executive Authority to appoint at will someone of his or her chosen party which might not be and usually isn't the will of the people.

Further, I would have allowed for the immediate Appointment of Representatives instead of having to organize an election to refill a vacant seat in time of emergencies.

But since I wasn't there... I have drafted a proposal for a twenty eighth amendment to cover this situation:

There is a hole in the Constitution of the United States that needs to be patched. This is not an oversight by the drafters, but a hole that has become a reality with the creation of modern weapon delivery systems. The elimination of our Representatives by an act of terror or war would cause a major disruption in our working government. I cranked this out and sent it off a day after 9/11 and once again, I respectfully propose the following 28th Amendment.

Description:
This amendment would alter the current ability of the State Executive authority to appoint at will, a replacement Senator of his/her own party, which could alter the balance chosen by the people. This amendment requires that the appointee be the same party as the person they are replacing.

By requiring a "same party distinction" of the appointee for either the House or the Senate, this amendment better serves the people and helps assure the balance of power in the Senate and House of Representatives until the people choose who will fill the seat.

It also eliminates the free hand to appoint to the Senate and limits appointments to a vacancy which must be filled with urgency.

Most importantly, it enables the legislature of any State to empower the Executive Authority to fill vacancies in the House of Representatives during such urgent times. This power is currently lacking, resulting in a situation which could effectively cripple our government if exploited by an enemy. Currently, The elimination of the majority of members of the House of Representatives would stop all new law making until elections could be held to replace the missing members.

And last, it limits the terms of the appointment and lays out rules for elections to ensure the return of choice to the people in a reasonable time frame.

Proposed Amendment XXVIII

In the event of a vacancy in the representation of any State in the Senate or House of Representatives the executive authority of such state shall issue writs of election to fill such vacancies: provided, that if the vacancy is the result of forces of nature, terrorist actions or an act of war, the legislature of any state may empower the executive thereof to make temporary appointments until the people fill the vacancy by election.

Said election must occur within 150 days of the date of the vacancy. The election will be to seat a replacement for the duration of the term of the member being replaced, unless, a general election is scheduled within the 150 days, in which case the appointee may run in that election as the incumbent and seek the seat for a full term. No appointee shall hold the seat beyond 180 days past the date of the vacancy unless elected by the people of the State.

No person shall be appointed or elected a Representative who shall not have attained to the age of twenty five Years, and been seven years a Citizen of the United States, and no person shall be appointed a representative who is not five Years a member of the same political party as the member he/she is replacing, and who shall not, when elected or appointed, be an Inhabitant of that State in which he/she is chosen.

No person shall be appointed or elected a Senator who shall not have attained to the age of thirty Years, and been nine years a Citizen of the United States, and no person shall be appointed a Senator who is not five Years a member of the same political party as the member he/she is replacing, and who shall not, when elected or appointed, be an Inhabitant of that State in which he/she is chosen.

I would have added term limits for members of the legislative branch for both Senators and Representatives. A term limit of 3 terms for Senators and 8 terms for Representatives.

I would have also added language clarifying the powers of states to amend the constitution.

I would have added an amendment for the protection of life.

I would have added a glossary defining the language in the constitution.

I would have clarified the limit of the federal government's powers to regulate interstate commerce.

I would have clarified further the limits of the power of the federal government to raise and levy taxes.

I would have further clarified the moral basis of our freedoms and laws.

I would have clarified the power of the legislative branch to impeach judges and on what basis they could be impeached.

And that is just for a start...

amendment 11 : any further amendments may only be added by a state by state basis. Congress may not pass any federal law that effects all states of the union unless ratified in those particular states.

I also would have made the 2nd amendment more specific. All people have the right to bear arms, irrespective of whether or not they are in a militia.

amendment 12 : all foreigners MUST register in the state in which they entered the union. failure to do so will result in immediate imprisonment, and or deportation. this is to prevent spies and mercenaries from overthrowing our govt, and from cheap labor destroying our standard of living.

amendment 13: any seperation of church and state does not prevent the state from displaying love and respect for God. it merely limits the govt from CONTROLLING and MANDATING a specific religion. any protests against a display of worship of God will result in imprisonment.

amendment 14: freedom of speech will not include : money given to politicians, defaming the name of God, pornographic material, or the funding of the arts by congress.

amendment 15 : homosexuality, being known by ALL the good peoples of the earth to be perversion, will be tolerated as long as there is no public display of homosexuality, nor protests for it's legitimacy.

Since special interest groups are the decline of our country, I would say they should have added the all candidates run for office out of a pool of money set aside just for candidate and that they cannot accept money or do favors for special interest groups.

The U.S. government should not only have a right to print and distribute the money for the country, but a duty as well. No third party entity, like the Federal Reserve, with owners in Europe, with questionable allegiance to our country, should be allowed to control its money supply.

Genius Larry J7. All that would do is motivate them to increase taxes to run a surplus and get a bonus, screwing us in the process. They needed to add a provision that swearing to uphold the constitution is punishable by public hanging if not adhered to. Also, that income tax would forever be illegal, thus preventing a 300-fold growth in the socialist welfare state in which we now live.

Before people vote or opinions are counted they must be tested to prove they are worth listenig to!

The US is now 17 out of the 22 industrialized nations in level of education...17!

Also Look at the segment "Jaywalking" in the NBC Tonight Show with Jay and see the stupidity of the average American when it comes to knowing anything!!!

So polls today on what to do in Iraq, or what are moral values, or what is correct or incorrect..? .LOL...

So yes, an IQ test and general knowledge requirement before listening to anyone on anything important!

I would have stated more clearly what everything ment so people would not have to keep going to the Supreme Court . Like for instance the right to bear arms. People try to say that means all weapons and other people say only certain weapons and how many.
