I worked for this company for nearly 6 years, they just terminated my employment on the 6th of this month. I have been sexual harassed by my supervisor and another employee that I was team leader over. I reported the harassment to my supervisors immediate boss (which is the manager of the warehouse) I told him on 2 different occasions about each persons harassment. I have documentation, but he didn't want to see it and he dismissed me like I was making it up. I later got fired talking to another employee (who I was team leader of also) about work. They dismissed me telling me my talking was a bad example to the other employees. I have had no prior problems with this issue and have never been written up for it or anything else for that matter. I have filed with the EEOC, what do you think my chances are in court?

Just to give you some figures, in fiscal Year 2006, EEOC received 23,034 charges alleging harassment as an issue. EEOC resolved 22,408 charges alleging harassment in FY 2006 and recovered $59.8 million in monetary benefits for charging parties and other aggrieved individuals. There are chances, and that would depend on your documentation on the case. Harassment is in violation of the 1964 civil rights act, and it is a very costly lawsuit if you have the proper documentation. An employer is automatically liable for harassment by a supervisor that results in a negative employment action such as termination, failure to promote or hire, and loss of wages. If you don't already have an employment law attorney, you need to obtain one.

Keep every shred of documentation you can find regarding the situation, write down names of witnesses who can vouch for your side of the story.

It is very good that you have documentation of the harassment, you attempted to report said harassment to management, were ignored and subsequentlly terminated. You have a very good case because it looks like you were fired because you reported sexual harassment (pretextual).

Usually most courts will require that you file a complaint with the EEOC and your state Human Rights Commission before a civil suit can be filed with them. This is why you need an attorney. I wouldn't rely on the EEOC or the state agencies if you want to win damages. You are much more likely to get a settlement if you have your own attorney.

hard to say, if you are saying they fired you in retaliation for reporting the harassment, that is a whistleblower charge...in some states if you win the company would have to pay punitive damages and your attorney's fees, so the stakes are high. if a suit is filed, it would be helpful if it gets written up in the local paper b/c a lot of these things are about hurting the company's image--know anyone who works at the paper? if the eeoc doesn't take it you'll need to find a private lawyer but your old job might want to settle out of court to avoid embarrasment.

If you were truly harassed and your employer didn't do anything about it, you should have gone the legal route instead of gossiping to other employees.

Sometimes in this life, we get exactly what we deserve.

You have a very good chance in court, you have documentation. They most likely have some too. Just make sure everything is truthful and can be proved. Go after them is what I say!
