Depends what your local ordinances are... Where I live, you can build up to a 12x10 foot shed, as long as it's not more than 8 feet tall, without any kind of permit needed at all. It can be made anyway you want, no permit required. There *are* setback restrictions, though (how far it has to be from your neighbor's property line) -- so you might have an issue there. I'd talk to your neighbor first, and express you concerns, and see if he'll be nice and do something. If he won't, find out what your local ordinances are, and act on them if he's in violation. It's usually the county that issues and manages building permits, although in big cities it's a city agency.

Here in Manitoba ,we are allowed an 8X8 structure without getting a permit.Although i also know a couple of people that have gotten away with 8 X 10.Hmmmm I wonder if they have connections on the inside, hahaha. These are city regs mind you.Country living might be different if it falls under municipality regs.

It is best that you contact them to find out. Doesn't cost a thing to call. Get a name of the person you spoke to and that way you will avoid any disputes in the future.

This may not help you, but in New Mexico, it's 120 sq/ft.

However, I think it can be as tall as you can make it logically.
