A while back I applied for a housekeeper job at a hotel. I was inteviewed by the head housekeeper who basically told me that I got the job, I just needed to meet with the new owner. When I came back later to meet with her and she learned that I was only 17 and couldn't work on Sundays (for religious reasons; I could work every other day of the week) she wouldn't let me have the job. Is this discrimination?
Also do you think people (and businesses) have the right to discriminate?

They might have been. But more likely they needed someone to work a certain schedule, and you couldn't fulfil that requirment. There is no way to really tell if they were really being discriminatory.

Yes and No.

Asking for Sundays off for religious reasons is a valid request, but it would be hard to prove that this is the reason you didn't get hired because of your age.

With regards to your age, certain occupations require the use of dangerous equipment and there are laws preventing employers from hiring people under a certain age. Depending on the duties that the hotel owner requires of housekeepers, you would come into contact with many different types of dangerous chemicals or hazardous equipment. It may not seem hazardous to run a floor waxer (buffer) or add chlorine to a pool, but certain machinery and chemicals require the user to be of a certain age. The hotel owner may not have had a choice. The person interviewing you may not have known the law.

If the job requires you to work Sundays and they are not able to work around that it's NOT discrimination. And that's probably what happened.

Don't jump to conclusions based on your belief, she has a business to run and probably can't accommodate you. The reality is, there are soooo many people in the service industry that want Sundays off, that it's almost impossible to have good consistent help on that day, and they need to require weekend availability. I bet if you told her Thursday nights you needed off, she would have been able to accommodate that.

And yes, people in business have a right to LEGAL discrimination. That's what an interview is after all. They don't have a right to ILLEGAL discrimination.

A business owner has the right to hire who they want to. If they don't like the way you comb your hair that's all the reason they need to not hire you. If they needed someone that could work on Sunday and you couldn't, nuff said.
It's not discrimination.

Yes, I think a business has the right to discriminate. As an example,, if I was a business owner and hiring, I'd give preference to a non-smoker.

The fact that you are 17 is not the issue. It's the Sunday thing. While I appreciate your reasons for not wanting to work on Sunday it is not the potential employers duty to do the same. Sunday is a busy day in that industry.

If they need someone to work Sundays they are not discriminating. They had a job opening to fill, they are not obligated to hire you if you were unavailable during the time frame you were needed in. This is not the same as not hiring you because you are Christian.

Also, age protection does not cover minors, they don't have to hire unaged and I can see lots of reasons why a hotel would not. For one, their insurance, for their Bond, may not cover minors.

I don't think it is discrimination. If the job requires you to be a certain age and have Sunday availability, then the employer has the right to find someone that fits their needs.

No this is no discrimination! Employers by law can fire or hire at will. They have no obligation to hire you if you can not fulfill a day that they are looking for. They can fire you just because they do not like you. The only thing they can't fire and etc for is sex, race, ethic and etc. They can't fire or not hire you solely because of your religion (say Christian). But if your religious obligations (church service) interferes with work schedule they can fire you not hire you in a heartbeat!

Yes.

Legally you can demand sundays off for religious reasons. However good luck proving that this is why you didn't get the job.

no its not discrimination but even if it was you dont want to work there if they require you to work sunday. sometimes you have to work sundays but if you can help it dont. The sabbath was made for man not man for the sabbath. if your ox is in a ditch you must get him out but like i say If you dont have to dont take that day to dedicate to the lord jesus set your sights on things above and dont concern yourself with trivial people that thinks their business is to important to shut down one day
